Court of Protection/Deputyship

When a person has lost the ability to decide matters for themselves it is necessary for someone to apply to the Court of Protection to be a deputy to deal with their affairs on their behalf. This will often be a family member, close friend or trusted professional.

Making an application to the Court of Protection can be a daunting prospect and we can assist you in a manner of different ways. We can make the application on your behalf or if you would prefer to make the application yourself, we can provide guidance along the way, including the costs involved. If you want us to handle the application from start to finish, we would begin by collating information about you and any other proposed deputies as well as the person whose affairs you wish to manage. We must also request a capacity assessment which is often provided by the individuals GP.

When the report has been obtained and all of the relevant information gathered, we will prepare the application for you to review and sign. The application is sent to the Court of Protection along with the relevant Court Fee. Once the Court has confirmed receipt of the application, we will advise you as to the next steps which will include serving notices and taking out deputy insurance. An application for Deputyship will often take between 6 and 12 months to be completed as this will have to be approved by a judge before an order is issued.
