What is a Statutory Declaration?

You may be asked to sign a Statutory Declaration when you are buying and selling property and find yourself asking what actually is a Statutory Declaration and why is it necessary?

A Statutory Declaration is a factual statement that something is true to the best of your knowledge and is often required where other factual evidence is not available. A Statutory Declaration may be required to;

· Correct an error in the spelling of your name in a deed or other document;

· Formally change your name or confirm you have adopted a name other than your legal name;

· Confirm that you have used land for a certain purpose for a period of time for example in support of an adverse possession claim;

· Confirm the use of access to your property where a right has not been granted for access;

· Declare you are not insolvent;

· Set out how original deeds and documents have been misplaced or destroyed.

The declaration must follow a set format and will need to be signed in the presence of a solicitor, commissioner for oaths or notary public. Interestingly, the solicitor, commissioner or notary attesting the declaration must be impartial and must not therefore be the same person that prepared the declaration.
